ARTICLE 1 – ORGANIZING COMPANY

The company KINETIK SPORT, a single-member limited liability company with capital of €7,500, registered with the Saint-Brieuc Trade and Companies Register under number 809 504 848, whose registered office is located at:

hereinafter referred to as the “Organizing Company,” is organizing a purchase-required contest entitled:

“Win a BXT Carbon Gravel Bike with KINETIK”

These rules define the conditions under which participants may take part in the contest, as well as the procedures for selecting and awarding the prize.

Participation in the contest implies full, complete, and unreserved acceptance of these rules.

ARTICLE 2 – DEFINITIONS

For the purposes of these rules, the following terms have the meanings set out below:

Participant

Any individual meeting the conditions set out in these rules.

Eligible order

A single order totaling at least €100 including VAT, placed on KINETIK’s official website and paid in full.

Contest

The “Win a BXT Carbon Gravel Bike with KINETIK” contest.

Prize

The bicycle described in Article 8.

ARTICLE 3 – DURATION

The contest runs from Saturday, August 1, 2026, at 12:00 a.m. to Monday, August 31, 2026, at 11:59 p.m. (Paris time).

Any participation registered before or after this period will be automatically rejected.

The Organizing Company reserves the right to modify these dates if necessary, in accordance with Article 14.

ARTICLE 4 – PARTICIPATION CONDITIONS

The contest is open exclusively to individuals:

• of legal age;
• having full legal capacity;
• residing in mainland France.

The following are excluded from participation:

• KINETIK SPORT employees;
• their spouses;
• their ascendants;
• their descendants;
• any person who has participated directly or indirectly in organizing the contest (service providers, technical partners, bailiff, etc.).

Only one participation is permitted:

• per person;
• per email address;
• per telephone number;
• per tax or postal household.

The Organizing Company may request any supporting documentation needed to verify these conditions. Any false declaration will immediately result in the cancellation of the participation.

ARTICLE 5 – PARTICIPATION TERMS

Participation is exclusively linked to a purchase made during the contest period.

Any order meeting the following criteria is considered eligible:

• placed on www.kinetikadrenalink.com ;
• with a minimum total amount of €100, including VAT;
• paid in full;
• not canceled;
• not refunded;
• not subject to any payment dispute.

The €100 threshold must be reached within a single order. Combining multiple orders is expressly excluded.

Each participant may enter the random draw only once, regardless of the number of eligible orders placed.

If the same person or household submits multiple entries, only the first validly registered entry will be retained.

Validation of an order constitutes full and complete acceptance of these rules.

ARTICLE 6 – ENTRY VERIFICATION AND FRAUD PREVENTION

The Organising Company reserves the right to carry out any checks it deems useful to ensure compliance with the provisions of these rules.

It may, in particular, request any supporting document allowing it to verify:

• the participant's identity;
• their age;
• their home address;
• the reality of the order placed;
• the actual payment for it.

Any entry containing inaccurate, incomplete, false or fraudulent information will be declared invalid.

The Organising Company also reserves the right to exclude anyone who attempts to disrupt the normal operation of the competition, particularly through:

• the creation of multiple customer accounts;
• the use of multiple email addresses;
• the use of multiple identities;
• identity theft;
• any attempt to manipulate the computer system or technical process;
• any payment fraud;
• any action intended to artificially increase the chances of winning.

Any fraud or attempted fraud will result in the immediate cancellation of the relevant entry, without prejudice to any civil or criminal action that the Organising Company may bring.

The decisions made by the Organising Company as part of the entry validity checks are reasoned and made in good faith.

ARTICLE 7 – RANDOM DRAW AND SELECTION OF THE WINNER

The random draw will be held on 15 September 2026, fifteen (15) calendar days after the closing of the competition.

It will be conducted under the supervision of a judicial officer, who will verify the regularity of the random draw operations and the winner's eligibility.

The draw will be conducted from all entries validly registered and not cancelled as of the date of the draw.

One main winner and several alternate winners may be selected.

The winner will be contacted by telephone and/or email within a maximum of five (5) business days following the draw.

They will have fifteen (15) calendar days to confirm their acceptance of the prize and, where applicable, provide the information required for its delivery.

If no response is received within this period, or if it proves impossible to contact the winner despite several reasonable attempts, the winner will be deemed to have definitively waived their right to the prize.

The prize will then be awarded to the first alternate winner, and, where applicable, to the subsequent alternates, following the same procedure.

No compensation may be claimed by a winner who has not responded within the deadline.

ARTICLE 8 – PRIZE OFFERED

The game offers the chance to win the following prize:

One (1) BXT Carbon Gravel bicycle

Indicative retail value: €4,500 including VAT (this value corresponds to the recommended retail price on the date these rules were drafted).

The prize is strictly personal. It is:

• non-transferable;
• non-exchangeable;
• non-refundable;
• non-divisible.

No financial compensation or benefit of any kind may be requested in lieu of the prize.

The photograph used in the communication materials is provided for illustrative purposes only and has no contractual value.

If the prize becomes permanently unavailable for a reason beyond the Organizing Company's control, the Organizing Company may replace it with a prize featuring equivalent or superior characteristics, without this substitution being subject to challenge.

ARTICLE 9 – PRIZE DELIVERY – TRANSFER OF RISKS – LIABILITY

The prize will be shipped to the winner's home or handed over in person, at the expense of the Organizing Company, after verification of their identity.

Ownership and risk transfer as soon as the bicycle is effectively handed over to the winner or to any person authorized by them.

From the time it is handed over, the winner alone assumes custody, safekeeping, maintenance, use, and all risks associated with the bicycle.

In particular, they are responsible for:

• to check that the bicycle is in good condition upon receipt;
• to follow the manufacturer's recommendations;
• to ensure its regular maintenance;
• to comply with all applicable traffic and safety rules.

The Organizing Company is neither the manufacturer, importer, nor professional distributor of the bicycle. Consequently, it provides no separate commercial warranty for the equipment. Any applicable warranties are the sole responsibility of the manufacturer or distributor, in accordance with the legal and contractual provisions applicable to them.

The Organizing Company may not be held liable for:

• a manufacturing defect;
• a hidden defect;
• normal wear and tear;
• lack of maintenance;
• misuse;
• any modification made by the winner;
• breakage;
• theft;
• loss;
• damage to the bicycle occurring after it has been handed over.

The Organizing Company may likewise not be held liable for any direct or indirect, material, non-material, or bodily damage suffered by the winner or by a third party in connection with the possession, transport, use, maintenance, or storage of the bicycle.

The winner remains solely responsible for the use of the prize and its consequences. If they so wish, they may take out insurance appropriate for using the bicycle.

In the event of loss, destruction, or theft of the prize after it has been awarded, no replacement, compensation, or refund may be claimed from the Organizing Company.

ARTICLE 10 – CANCELLATION OF ENTRY – RIGHT OF WITHDRAWAL – REFUND

In accordance with the provisions of the French Consumer Code, any order that enabled participation in the competition remains subject to the consumer’s statutory rights, including the right of withdrawal where applicable.

However, where an order that gave rise to an entry is subject to:

• a withdrawal;
• a cancellation;
• a full refund;
• a partial refund that reduces the order amount below the threshold of one hundred euros (€100, including VAT);
• the return of one or more items having the same consequence;
• an unpaid amount;
• a bank rejection;
• a payment dispute;
• or any payment fraud,

before the date of the prize draw, the corresponding entry will be automatically cancelled.

If a refund occurs after the prize draw and it appears that the participation requirements were no longer met on the date of the draw, the Organizing Company may cancel the award of the prize and award it to the first alternate winner.

ARTICLE 11 – PERSONAL DATA

The personal data collected as part of this competition is processed by KINETIK SPORT, acting as the data controller, exclusively for the purposes of:
•    to record entries; 
•    to verify their validity; 
•    to organize the prize draw; 
•    to contact the winner; 
•    to award the prize; 
•    to comply with the legal obligations of the Organizing Company. 

The data that may be collected includes:
•    surname; 
•    first name; 
•    postal address; 
•    email address; 
•    telephone number; 
•    order-related information. The data is retained for the period strictly necessary to manage the competition and comply with applicable legal obligations.

In accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the French Data Protection Act, each participant has:
•    the right of access; 
•    the right to rectification; 
•    the right to erasure; 
•    the right to restriction of processing; 
•    the right to object where applicable; 
•    the right to data portability. 

These rights may be exercised by post sent to KINETIK SPORT’s registered office or by email, in accordance with the procedures indicated in the Privacy Policy available at: https://www.kinetikadrenalink.com/policies/privacy-policy.

Participants also have the right to lodge a complaint with the French Data Protection Authority (CNIL).

ARTICLE 12 – MODIFICATION, SUSPENSION OR CANCELLATION OF THE COMPETITION

The Organizing Company reserves the right, if circumstances so require and subject to compliance with applicable regulations, to amend these rules, extend or shorten the duration of the competition, postpone the draw, temporarily suspend the competition, or cancel the operation in whole or in part.

Such decisions may in particular be made in the event of force majeure, a natural disaster, a pandemic, an administrative decision, a supplier failure, the unavailability of the prize, a major technical incident, widespread fraud, or any event beyond the control of the Organizing Company.

Any amendment to the rules shall be published on the KINETIK website and shall take effect as soon as it is posted online. Participants may not claim any compensation as a result of these amendments.

ARTICLE 13 – LIABILITY OF THE ORGANIZING COMPANY

The Organizing Company shall take all necessary measures to ensure the proper conduct of the competition.

However, its liability may not be incurred, in particular, in the event of:
•    malfunction of the Internet network; 
•    computer failure; 
•    server failure; 
•    interruption of electronic communications; 
•    human or computer error; 
•    hacking; 
•    computer virus; 
•    loss of data; 
•    temporary unavailability of the website; 
•    delay or loss of mail or a parcel attributable to postal services or the carrier; 
•    any circumstance beyond its control that disrupted the normal course of the competition.

The Organizing Company does not guarantee uninterrupted access to the website throughout the duration of the competition.

It shall not be held liable for consequences related to participants' improper use of the website.
